Lindup v Agus – Claim under the Inheritance (Provision for Family and Dependants) Act 1975 The High Court have granted a woman’s request to make a claim against the estate of her deceased ‘cohabitee’ despite her main postal address being different from the deceased.
The deceased died from a brain haemorrhage aged 37 in 2007. In 2002 the deceased had asked the claimant to move in with him, which she did gradually due to her previous relationship breakdown and the fact she was currently going through contact proceedings regarding her child.
The Court concluded that, despite using a different postal address, the couple lived together as ‘man and wife’ and she should be able to bring a claim for ‘reasonable provision’
